Privacy Policy

The version currently online of our Privacy Policy is the only binding version for the entire duration of the application's use, until a new version replaces it. The user must be notified of the new version if applicable.

The following terms shall refer to:

  • "Application": the Pass Jeunes application to be installed on iOS or Android.
  • "User": the internet user visiting and using the application's services.
  • "Publisher": the Ministry of Youth, Culture and Communication, responsible for editing and managing the content of the application.
  • "Data Controller": The natural or legal person, public authority, institution or any other body which, alone or jointly with others, determines the purposes and means of processing Personal Data, including security measures concerning the operation and use of Pass Jeunes. Unless otherwise stated, the Data Controller is the Pass Jeunes Owner.
  • "Personal Data": Any information that, directly, indirectly, or in connection with other information – including a personal identification number – allows the identification or identifiability of a natural person, as provided by Article 1 of Law No. 09-08 enacted by Dahir 1-09-15 of February 18, 2009, relating to the protection of natural persons with regard to the processing of personal data.
  • "Usage Data": Information collected automatically by Pass Jeunes (or by third-party services used by Pass Jeunes), which may include IP addresses or domain names of computers used by Users, URI addresses (Uniform Resource Identifier), the time of the request, the method used to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server's response (successful result, error, etc.), the country of origin, browser and operating system characteristics, time details per visit and details about the path followed in the Application with special reference to the sequence of pages visited, and other parameters relating to the operating system or computing environment of the User.

Article 1 – Acceptance of Application Content

The User must commit to carefully reading the content of this document, and expressly and unreservedly accepts all the rules and obligations set out therein.

Article 2 - Access to the Application

Access to and use of the application is reserved for strictly personal use. You agree not to use this application and the information or data contained therein for commercial, political, or advertising purposes.

Article 3 - Application Content

All trademarks, photographs, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, as well as all computer applications that may be used to operate this application, and more generally all elements reproduced or used on the application are protected by applicable intellectual property laws. They are the sole and complete property of the publisher or its partners.

Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the publisher, is strictly prohibited and engages the legal liability of the author. The fact that the publisher does not initiate proceedings upon becoming aware of such unauthorized uses does not constitute acceptance of such uses or waiver of prosecution.

Article 3.1 - Sharing Personal Data with Third Parties

Collected personal data may be transferred to N+ONE, located at 2, rue Hmida Lakrari -ex Celli – 20000 (Hosting Provider) and SEOCOM SARL, located at Floor 1 Imm C Apt 3 residence Al Abraj Bokar Marrakech 40030 Marrakech, Morocco (Managed Services Provider) for storage and hosting purposes.

Article 4 - Application Management

For the proper management of the application, the publisher may at any time:

  • Suspend, interrupt or limit access to all or part of the application, reserve access to the application, or certain parts thereof, to a specific category of internet users
  • Delete any information that may disrupt its operation or that contradicts national or international laws, or the rules of Netiquette (etiquette rules used on the Internet)
  • Suspend the application to perform updates.

Article 5 - Responsibilities of the Publisher and Data Controller

The publisher's liability cannot be engaged in cases of failure, breakdown, difficulty or interruption of operation, preventing access to the application or any of its features. The connection equipment to the application that you use is entirely your responsibility. You must take all appropriate measures to protect your equipment and your own data, particularly from viral attacks via the Internet.

You are also solely responsible for the sites, applications and data you access. The publisher cannot be held liable for any legal proceedings brought against you:

  • Due to the use of the application or any service accessible via the Internet;
  • Due to your non-compliance with this Privacy Policy.

The publisher is not responsible for damages caused to yourself, to third parties and/or to your equipment due to your connection or use of the application, and you therefore waive any action against them. If the publisher becomes subject to amicable or judicial proceedings due to your use of the application, they may seek recourse against you to obtain compensation for all damages, amounts, judgments and costs that may arise from such proceedings.

Article 6 - Hyperlinks

The establishment by users of any hyperlinks to all or part of the application is authorized by the publisher. Any link must be removed upon simple request by the publisher. The publisher is not responsible for information published and accessible via a hyperlink published on the application. The publisher has no rights over the content present in said link.

Article 7 - Data Collection and Protection

The information collected on the application is processed to provide offers to young people between 16 and 30 years old (free services, discounts, etc.) granted either by the Ministry of Youth, Culture and Communication or by its partners.

In accordance with Law No. 09-08 enacted by Dahir 1-09-15 of February 18, 2009, relating to the protection of natural persons with regard to the processing of personal data, you have a right of access and rectification to information concerning you, which you can exercise by contacting contact@passjeunes.ma. You may also, for legitimate reasons, object to the processing of data concerning you. This processing has been notified and authorized by the CNDP under receipt/authorization No.……. of …….

  • First and last name
  • Age and date of birth
  • Postal address
  • National ID (CIN)
  • Email address
  • Phone number
  • Professional activity
  • Photo

Article 8 - User Rights

Under applicable personal data regulations, users have the following rights:

  • Right of access: you may exercise your right of access, to know the personal data concerning you, by writing to the following email address: contact@passjeunes.ma. In this case, before implementing this right, the application owner may request proof of your identity to verify its accuracy.
  • Right of rectification: if the personal data held by the application owner is inaccurate, you may request that the information be updated.
  • Right to erasure: you may request the deletion of your personal data, in accordance with applicable data protection laws.
  • Right to restriction of processing: you may ask the application owner to restrict the processing of personal data in accordance with the General Data Protection Regulation.
  • Right to object to data processing: you may object to your data being processed in accordance with the cases provided for by the General Data Protection Regulation (GDPR).
  • Right to data portability: you may request that the application owner provide you with the personal data supplied in order to transfer it to another site.

Any request must be accompanied by a photocopy of a valid, signed identity document, and must state the address to which the application publisher can contact the applicant. The response will be sent within one month of receiving the request. This one-month period may be extended by two months if the complexity and/or number of requests so requires.

Article 9 - Data Use

Personal data collected from users aims to provide application services, improve them, and maintain a secure environment. More specifically, the uses are as follows:

  • Access and use of the application by the user;
  • Management of the application's operation and optimization;
  • Implementation of user assistance;
  • Verification, identification and authentication of data submitted by the user;
  • Prevention and detection of fraud, malware (malicious software) and management of security incidents;
  • Management of any disputes with users.

Article 10 - Data Retention Policy

The application owner retains your data to provide its services or assistance. This is done to the extent reasonably necessary or required to comply with legal or regulatory obligations, to settle disputes, prevent fraud and abuse, or enforce our terms and conditions. We may also retain some of your information if necessary, even after you have closed your account. Your data is retained for up to 12 months after closure.

Article 11 - Applicable Law

This Privacy Policy is governed by Moroccan law and subject to the jurisdiction of the courts at the publisher's registered office, subject to any specific attribution of jurisdiction arising from a particular statutory or regulatory text.
