Terms and Conditions of Use

Preamble

These 'Terms and Conditions of Use' (TCU) aim to legally frame the terms of use of the mobile Application (hereinafter referred to as 'Pass Jeunes') by the user (hereinafter referred to as the 'User or Young Beneficiary').

The terms and conditions of use must be accepted by any User wishing to access Pass Jeunes offers. They constitute the contract between Pass Jeunes and the User.

The User must commit to carefully reading the content of this document, which includes the General Terms and Conditions of Use, and expressly and unreservedly accepts all the rules and obligations set out therein.

The User's access to Pass Jeunes signifies their acceptance of these TCU.

Where applicable, if the User does not accept the terms and conditions of use stipulated in this contract, the User must refrain from accessing the offers proposed by Pass Jeunes.

Access to Pass Jeunes Offers

Pass Jeunes provides the user with free access to the following services:

  • Benefit from offers listed by the Ministry on the mobile application;
  • Follow current events and the cultural agenda (on Pass Jeunes, by email or notification).

Pass Jeunes is freely accessible anywhere to any User with Internet access. All costs borne by the User to access the service (hardware, software, Internet connection, etc.) are their responsibility.

Pass Jeunes implements all available means to ensure quality access to its services. As this is a best-efforts obligation, Pass Jeunes does not commit to achieving this result.

Any event due to force majeure resulting in a network or server malfunction does not engage the Ministry's liability.

Access to Pass Jeunes services may at any time be subject to interruption, suspension, or modification without notice for maintenance or any other reason. The User agrees not to claim any compensation following such interruption, suspension, or modification of this contract.

Use of Cookies and Trackers

The Application uses Google Analytics services whose terms of use are available here: https://marketingplatform.google.com/about/analytics/terms/fr/.

Intellectual Property

The trademarks, logos, signs, and all other content of the Pass Jeunes application are protected by intellectual property law and in particular by copyright.

The User must obtain prior authorization from Pass Jeunes for any reproduction, publication, or copying of its contents.

The User agrees to:

  • Use Pass Jeunes content strictly within a private context. Commercial use of content is strictly prohibited.
  • Not post content that may harm the interests of third parties.
  • Create only one personal account corresponding to their identity.
  • Remain solely responsible for any use made of their login credentials and password, their confidentiality, and any use of their personal account.
  • Immediately report any use or risk of fraudulent use of their personal account, and any breach of confidentiality and security of their credentials to the contact email address.

Without this list being exhaustive, the User is informed that it is strictly prohibited to:

  • Engage in unauthorized or fraudulent use of the Application and/or its content for unlawful purposes or effects;
  • Access or attempt to access restricted resources or areas of the Application without meeting the required access conditions;
  • Introduce or spread computer viruses or any other physical or logical system likely to cause damage to the Application's physical or logical systems, other Users, or any third party;
  • Submit content that may constitute a press offense under Law No. 88-13 on the press and publishing enacted by Dahir No. 1-16-122 of 6 Kaada 1437 (August 10, 2016);
  • Disseminate any data, information, or content that is defamatory, insulting, obscene, racist, xenophobic, shocking, inciting hatred or violence, threatening, constituting harassment, or generally any content contrary to applicable laws and regulations, public morality, or public order.

Any legal action brought by an injured third party against the site will be assumed by the User.

The interpretation and validity of these TCU is subject to Moroccan law and regulations in force, to the exclusion of any other legislation, regardless of the User's nationality. In the absence of an amicable agreement and if negotiations fail, the dispute will be brought before the Moroccan courts of the Kingdom.

User content may at any time and for any reason be deleted or modified by the Pass Jeunes application without prior notice or justification.

The TCU may also be modified at any time without notice. Users will be informed through the publication of updated TCU on the application and a notification within the application. The modified TCU will take effect from publication. Continued use of the application constitutes acceptance of the new version.

Personal Data

By checking a box on the data collection form (registration form), which refers to the TCU including a clause on the protection of personal data, the User consents to the computerized processing of all data provided. This data may be used for communication purposes in connection with processing the file and will not be used for direct or indirect marketing activities.

The Ministry commits to processing the data communicated to it in accordance with Law No. 09-08 on the protection of natural persons with regard to the processing of personal data enacted by Dahir No. 1-09-15 of 22 Safar 1430 (February 18, 2009), which established a national personal data protection commission.

We request and collect the following personal information when you use the Pass Jeunes service. This information is necessary for the proper execution of this service and to meet our legal obligations. Without it, we may not be able to provide all requested services.

  • Account information: When applying for a Pass Jeunes, we ask for your first name, last name, age, phone number, email address, city, CIN number, a selfie/photo, and a scanned copy of the CIN;
  • Information we automatically collect when you benefit from a Pass Jeunes offer.

When you use the Pass Jeunes service, we automatically collect information, including personal information, necessary for the execution of our agreement, legal compliance, and our legitimate interest in providing our partners' offers.

1. Use of Information We Collect

Information collected on the application is processed to provide offers to young people between 16 and 30 years old (free services, discounts, etc.) granted by the Ministry of Youth, Culture and Communication or its partners.

In accordance with Law No. 09-08 enacted by Dahir 1-09-15 of February 18, 2009, you have a right of access and rectification to information concerning you, which you can exercise by contacting contact@passjeunes.ma. This processing has been authorized by the CNDP under receipt/authorization No.……. of …….

Personal data collected by the Publisher may be transferred to N+ONE, located at 2, rue Hmida Lakrari -ex Celli – 20000 (Hosting Provider) and SEOCOM SARL, located at Floor 1 Imm C Apt 3 Al Abraj Bokar Marrakech 40030, Morocco (Managed Services Provider) for storage and hosting purposes.

You may exercise any right described in this section by sending an email to contact@passjeunes.ma. We may ask you to verify your identity before taking further action on your request.

2. Managing Your Information

You can update some of your information (email, password) in the profile section of the Pass Jeunes application. You are responsible for keeping your personal information up to date.

3. Rectification of Inaccurate or Incomplete Information

You have the right to ask us to correct inaccurate or incomplete personal information about you that you cannot update yourself on the application.

4. Data Access and Portability

Applicable law may authorize you to request copies of your personal information that we hold, in a structured, commonly used, machine-readable format, and/or to ask us to transmit this information to another service provider where technically possible.

5. Data Retention and Deletion

In general, we retain your personal information for as long as necessary for the performance of the agreement between you and us and to comply with our legal obligations. You can ask us to delete your personal information if you no longer wish us to use it to provide Pass Jeunes services.

Please note that residual copies of your personal information may not be deleted from our backup systems for a limited period, as we maintain the application to protect it from accidental or malicious loss.

Upon downloading the Application, these TCU are subscribed for an indefinite period from their acceptance by the User.

Account Suspension – Termination

1. At the User's Initiative

The User may at any time request the deletion of their account via the Application or by sending a request to contact@passjeunes.ma. Account deletion results in the loss of the User's Credit.

The User may cancel the deletion of their account if the cancellation process was initiated less than 30 days ago. Once the 30-day period has elapsed, the account will be permanently deleted.

2. At the Ministry's Initiative

  • When the User reaches the age of 31, their Pass Jeunes automatically expires, cancelling any unused credit.
  • The Ministry may terminate the use of the Application at any time by giving Users 30 days' notice.
  • At the time of any termination, the rights granted to Users will be terminated.
  • In the event of a correctable breach of obligations (e.g., outdated or incomplete information), the Ministry will inform the User and request corrective action. Failure to respond or correct may result in suspension pending compliance.
  • In case of suspected fraud, the Ministry will immediately block the account. The User must provide all useful information for account recovery.
  • Any serious and/or uncorrectable breach of obligations, such as identity theft or proven Credit fraud, will result in account deletion.
  • Account deletion for breach of obligations results in the loss of the Credit balance and the obligation to repay any sums unduly received by the Ministry.
  • The Ministry may take legal action against the User, seeking reimbursement of all costs incurred through non-compliant use of the Credit and compensation for damages.

Links to Other Sites

The Application may contain links to third-party websites or applications. Linked sites are not under the Ministry's control, and the Ministry is not responsible for their content. The Ministry disclaims all liability for any technical problem or security flaw originating from a hyperlink posted on its Application or Site.

It is the User's responsibility to perform all necessary checks before proceeding with any transaction with third parties outside the Application.
